European Court of Human Rights Adopts First Judgement against Serbia

The YUCOM committee of human rights lawyers of Serbia won its first litigation against the state of Serbia in front of the European Court for Human Rights.
The judgment of the Court determines that Serbia engaged in violation of rights listed in articles 6, 8 and 13 of the European Convention on Human Rights, i.e. the rights to privacy and private family life, the right to just trial and the right to effective legal remedy. On YUCOM’s request, the Court decided to protect the identity of the victim. YUCOM emphasized that this was the first judgment in which the European Court of Human Rights decided on violations of rights guaranteed in the European Convention on Human Rights and obligated Serbia to stop the violations and compensate the victim justly. B92 reports that the lawsuit referred to the complaints by citizen V.A.M. about the prolonged and unfair divorce procedure and the resulting decision denying her custody over her child. She was prevented from visiting her child for eight years because she is HIV infected. The decision in V.A.M. vs. Serbia was adopted on March 13 and obligates the state to compensate V.A.M. with 15.000 EUR in non-material damages and to cover the procedurals costs of 4,350 EUR. |
